Website Terms of Use

These terms govern your access to and use of the QMS Asset Integrity website. They do not form part of any contract for the supply of inspection, testing, coatings or remediation services - those are governed by our separate written terms of supply.

1. Acceptance

By accessing or using the QMS Asset Integrity website at qmsndt.com.au (the "Site") you agree to be bound by these terms of use. If you do not agree, please do not use the Site.

2. Information is general only

The content of the Site - including descriptions of services, accreditation scope, capability statements, project examples and contact information - is provided for general information only. It is not technical, engineering or legal advice and must not be relied on as such. Specific advice for your asset, plant or project should be obtained in writing from QMS as part of an engagement governed by our written terms of supply.

3. Accreditation and scope

QMS is accredited by NATA (Accreditation No. 18957) under ISO/IEC 17025:2017 for the specific tests and inspections listed on our scope of accreditation. References on this Site to "NATA-accredited" services should be read together with the accredited scope of each individual office. Some services described on the Site fall outside the accredited scope and are provided on a non-accredited basis - we will identify which is which on quotation.

4. Intellectual property

All content on the Site, including text, photographs, logos, graphics, schema and source code, is owned by QMS or licensed to QMS. You may view and download a single copy for personal, non-commercial reference. Any other reproduction, republication, distribution or commercial use requires our prior written consent. The QMS Asset Integrity name and logo are trade marks of QMS.

5. Permitted use

You may not:

  • Use the Site for any unlawful purpose or in any way that could damage, disable, overburden or impair the Site;
  • Attempt to gain unauthorised access to the Site, related systems, or any account or data;
  • Use any automated means (bots, scrapers, harvesters) to extract data from the Site beyond ordinary search engine indexing;
  • Submit content through the contact form that is misleading, abusive, defamatory, infringes intellectual property rights, or contains malicious code.

6. Third-party links

The Site contains links to third-party websites (for example, NATA's directory of accredited organisations and external research articles). Those links are provided for convenience only - QMS does not endorse, control or accept responsibility for the content of those external sites.

7. No warranties

To the maximum extent permitted by law, the Site is provided on an "as-is" basis without any warranty of any kind, whether express or implied, including warranties of fitness for purpose, merchantability, accuracy, availability or non-infringement. QMS does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of liability

To the maximum extent permitted by law, QMS will not be liable for any direct, indirect, incidental, special, consequential or exemplary damages (including loss of profits, revenue, data, goodwill or business opportunity) arising from or connected with your access to or use of the Site, even if QMS has been advised of the possibility of such damages. Where statutory consumer guarantees cannot be excluded, QMS's liability is limited to the maximum extent permitted by the Australian Consumer Law.

9. Privacy

Personal information collected through the Site is handled in accordance with our Privacy Policy.

10. Governing law

These terms are governed by the laws of South Australia, Australia. You submit to the non-exclusive jurisdiction of the courts of South Australia and any courts hearing appeals from those courts.

11. Changes

We may update these terms from time to time. The current version is always published at https://qmsndt.com.au/terms with an effective date.
